Charlotte-Mecklenburg Police Department’s North Division officers have taken into custody the individual responsible for the sexual assault involving a 12 year old CMS student from earlier this morning at 3200 Dalecrest Dr. in North Charlotte.At approximately 8:16 a.m. on Wednesday, October 8, 2008 officers responded to call for service in reference to an individual who had just been raped. According to the victim’s statement she advised that while waiting to catch a CATS bus at the Transit Center to take her to her CMS bus stop a man approached her and followed her onto the CATS bus.
The victim advised that she got off the CATS bus in the Tanglewood Community to catch her school bus and the suspect followed her off of the bus.
The CMS bus had already left the bus stop so in turn the victim began walking to a relative’s house that was nearby. Approximately one hundred feet from the bus stop the suspect grabbed her, forced her into a wooded area fifteen feet from the roadway, and sexually assaulted her. Several witnesses nearby heard the victim screaming for help and went to investigate. When the witnesses were running to the aid of the victim, the suspect began running away. At this time the witnesses jumped into a van, followed the suspect up the street, and caught him about three blocks away. The witnesses detained the suspect until officers arrived on scene.
Marcus Maurice Kennedy was arrested for the sexual assault and was charged with First Degree Rape and Kidnapping. Mr. Kennedy’s arrest history in Charlotte-Mecklenburg goes back to 1996 including twenty-one prior arrests, ten misdemeanor and two felony convictions. Some of his prior arrests include charges of assault, larceny, damage to property, trespassing, loitering, possession of stolen property, and carry a concealed weapon.
According to the Mecklenburg County District Attorney’s Office, Mr. Kennedy pled guilty to indecent liberties with a minor on September 2, 2002, pled guilty to failing to register as a sex offender in Mecklenburg County on November 6, 2006 and has a pending drug charge as of October 8, 2008.
Kennedy was transported to Police Headquarters and interviewed by Detectives from the Special Victims Division. He is currently being held in the Mecklenburg County Jail.

Another example of a failed criminal justice system in Charlotte/Mecklenburg. With all the convictions Mr. Kennedy has, being a failed to register sex offender, and still on the street, this is squarely on the shoulders of those we ELECTED to insure the criminals pay for their crimes, and the citizens of Char/Meck are safe. How many more women are gonna be raped, how many more children molested, how many more citizens are gonna be robbed, shot, maimed, and killed before we hold the DA's office and the liberal judges accountable?

I heard from an expert on the radio that he should be fitted with a monitoring device, and also get advanced placement into a sex offender rehabilitation class so he can control his urges. unfortunately, this is the mindset of our criminal justice system. Even the Supreme Court has struck down laws that they deemed as too harsh on sex offenders(laws that were enacted by an elected representative government... that means these people in robes have stolen your right to vote ).
Statistics have proven; there is NO EFFECTIVE rehabilitation for sexual preditors.
AND as long as Gilchrist is the DA, the same DA that dismissed charge after charge of this monster, this situation is never going to change. We need to elect a DA that will prosecute criminals. We need to elect judges that will refuse bond when appropriate and will give long sentences to career criminals.
Too bad this "animal" didn't break into someones home so they could have put him out of his misery once and for all.

These thug hugging judges, and politicians pushing for CMPD to arrest fewer criminals, are responsible for this little girl being raped! Nice job guys! Keep hugging those thugs, and telling yourself that monsters who prey upon children can be reformed.
I called the NC court house on 4th street. I asked how I could go about tracking the judges responsible for setting this monster free. I was informed that in a lot of cases, a judge may not have been involved... but that I should call the DA's office for further assistance. There has to a paper trail, and I want to make damn sure that I'm not voting for people responsible for releasing these criminals back onto the street to rape or kill other children.
The best thing to do is clean the whole "nest" out. 35 plus years is too long for Gilchrist. He should have been sent to pasture long, long ago. Get rid of the whole bunch of Judges also. We need new blood to stop the blood in the streets.

May god bless the 12 year old who was raped by this animal. I sincerely hope that Gilchrist and his office rot in hell as they continue to wreak havoc and rain sorrow upon Charlotte. The man clearly has no conscience and no ethics of any kind. He is scum and a weasel that continues to cause major crime problems in Charlotte. As for the rapist, I only wish he would be free to break into my home so I could empty my weapon in his head and throw his ass out after he's gone.
I looked at the file today at the courthouse, Falston was one of the judges involved in this monster's release.
My mistake, the name is Shirley Fulton (not Falston). Either way, the woman is still awful. She's no longer a judge in Meck Co., but is trying to "change the justice system" in NC.

The problem with the Judges is the same with the DA, it's a good ole boy club elbow to elbow with the city fathers.
Gilchrist has run unopposed for the last three elections. Nobody wants to be the person to buck this Charlotte system, they all work together.
Shame on them. We as citizens deserve better and it can start by voting out these toady judges.
If you are a Democrat, write or call the local party. Next time they come calling for a donation, tell them why you are unhappy with this, and tell them your not voting for their politicans, judges and DA.
If you are a Republican, write or call your party, ask them why the DA has run unopposed for the last three elections, ask them what are they doing about crime, and tell them you not voting for their toady hacks.
If you're an independant, tell both parties how unhappy you are.
Things must change.
Peter Gilchrist should be fired. Seriously. He is part of the problem. Our elected officials are wasting our time and our money. If they cant do the job, fire them. Thats what happens in the real world. You go to work, do a sub-par job, you lose your job. Instead, we allow people like Gilchrist to continue in the role he is in, endangering the citizens & protecting the criminals. He is well on his way to becoming a career politician. Get paid, do nothing.
Poor little girl, this guy should be put to death! Kudos to the hero that helped her!!! I have a daughter her age, and don't know how I would handle it if it happend to her. It is so sad that this happend, specially when it could have been avoided.I wonder how Gilchrist can sleep at night.

Marcus Maurice Kennedy has committed. I'm a victim of molestation, and yes this happened when I was a child. We teach our children to say 'Stranger Danger', and all of the key action words. In this case it seems as if a scream of the child is what went to the ears of the Angels. I pray that his young princess will Rise Up, and be a beacon of light for those that have been so violently taken advantage of, and those that are in secret to come forward. LOVE SHOULD NEVER HURT. I Thank God that the child is alive, that there were angels around to help. THANK GOD FOR YOU! The person that committed this crime should NEVER be allowed to walk the streets again, ever. It's time that you wake up Mecklenburg, and realize that these criminals take you as a joke, the judicial system is a BIG JOKE to them. DA & office. Do you finally realize this? After a inmate is released 2 or 3 times, it's called a few, and YOU need to take a serious look at the crimes, better yet the reason that YOU keep seeing them there.
