SHELBY, N.C. – A Shelby man is facing charges of felony death by vehicle and driving while impaired after police say he flipped his car, killing a passenger.

A person called the Shelby Police Department just before 6:30 a.m. Friday to report someone had fired gunshots into their house. The caller also told police that the shooter’s car had overturned in front of the house.

When officers arrived, they found a passenger had been thrown from the vehicle and killed. Police said they are withholding the name of the dead passenger until that person’s family has been notified.

The driver of the car, 42-year-old Richard Ray Martin, was arrested. He was charged with felony death by vehicle and driving while impaired.

Martin is currently being held in the Cleveland County Detention Center under $250,000 secured bond. He has a court hearing scheduled for Monday.

No charges have been filed yet in connection with the shooting, but Shelby Police officials said the investigation is ongoing and more charges are expected.

No one in the house was injured by the gunshots, police said.
