DA’s Crimes Against Persons Team Convicts 49 Defendants

CHARLOTTE, N.C. Forty-nine (49) defendants pled guilty in Mecklenburg County Superior Court before The Honorable Yvonne Mims Evans, Superior Court Judge, during the week of November 12, 2012. The defendants entered their guilty pleas in courtroom 5350.  Among them were:

Derrick Summers, 30, pled guilty to attempted murder. Summers was sentenced to 108-142 months in prison.

Rico Sinclair, 42, pled guilty to possession of a firearm by a felon  and admitted his status as a habitual felon. Sinclair was sentenced to 75-99 months in prison.

Brendon May, 28, pled guilty to assault with a deadly weapon inflicting serious injury. May also admitted his status as a habitual felon. May was sentenced to 67-90 months in prison.

Elvis Padilla, 24, pled guilty to 1) first degree burglary, 2) larceny of a motor vehicle, 3) six counts of breaking or entering and 4) larceny after breaking or entering. Padilla was sentenced to 51-74 months in prison.

Michael Smith, 19, pled guilty to 1) two counts of robbery with a dangerous weapon and 2) conspiracy to commit robbery with a dangerous weapon. Smith was sentenced to 44-65 months in prison.

Purcell Young, 29, pled guilty to 1) conspiracy to commit robbery with a dangerous weaponand 2) second-degree kidnapping. Young was sentenced to 34-57 months in prison.

Damarius Massey, 22, pled guilty to conspiracy to commit robbery with a dangerous weapon. Massey was sentenced to 37-54 months in prison.

Onslow Black, 32, pled guilty to 1) assault with a deadly weapon inflicting serious injury and 2) possession of a firearm by a felon. Black was sentenced to 30-48 months in prison.
Aaron Echols, 43, pled guilty to 1) two counts of felonious restraint, 2) two c ounts of perjury and 3) two counts of impersonating a law enforcement officer. Echols was sentenced to 30-36 months in prison.  At the completion of his prison sentence, Echols received a consecutive sentence of 13-16 months in prison; that sentence was suspended pending his successful completion of 36 months of supervised probation.

Khalif Clark, 26, pled guilty to 1) conspiracy to commit robbery with a dangerous weapon and 2) conspiracy to commit first degree burglary. Clark was sentenced to 23-37 months in prison.

Austin McEntire, 18, pled guilty to conspiracy to commit robbery with a dangerous weapon.  McEntire was sentenced to 17-33 months in prison.

David Henson, 17, pled guilty to conspiracy to commit robbery with a dangerous weapon.  Henson was sentenced to 15-30 months in prison.

Jeremy Princell, 36, pled guilty to 1) indecent liberties with a child and 2) two counts of sexual battery. Princell was sentenced to 15-18 months in prison. At the completion of his prison sentence, Princell received a consecutive sentence of 75 days in prison; that sentence was suspended pending his successful completion of 36 months of supervised probation.

Avery Forney, 22, pled guilty to accessory after the fact to robbery with a dangerous weapon. Forney was sentenced to 15-18 months in prison.

Xayver Warner, 18, pled guilty to common law robbery. Warner was sentenced to 13-16
months in prison.

Antoine Nicholson, 19, pled guilty to common law robbery. Nicholson was sentenced to 12-24 months in prison.

Chad Clay, 20, pled guilty to1) possession of a firearm by a felon and 2) assault on a female. Clay was sentenced to 12-24 months in prison.

Note:  Almost all guilty pleas entered in criminal administrative court are the result of an agreed upon plea arrangement between the State and the defendant, which is then approved by the sentencing judge.
