YORK, S.C. – York police have arrested two parents accused of withholding medical care from their premature sons, who doctors eventually diagnosed as “failure to thrive.”

In March, a caseworker with the York County Department of Social Services notified police that two infant boys hadn’t received necessary medical care while living with their mother, Shavon Michelle Phillips-Young, 26, and their father, Dustin Shad Ruff, 19, at an East White Street home, according to a Rock Hill Police report.

The boys, police say, were born prematurely at 32 weeks in December.

On Monday, police signed warrants for both parents charging them with two counts each of unlawful conduct toward a child, according to police documents. York Police found the couple on Wednesday and arrested them.

Police obtained records from Piedmont Medical Center and Tri-County Pediatrics showing that Phillips-Young, Ruff and their sons missed six scheduled appointments over the span of two months, Bollinger said.

They successfully went to two appointments, during which doctors noted that the boys were not growing properly, Bollinger said. Eventually, the boys were diagnosed as “failure to thrive.”

Phillips-Young and Ruff said they couldn’t make some of the scheduled visits because they were unable to secure transportation, according to reports.

Court records show that Ruff was charged last week with possession of marijuana. His case is pending. State records show that Phillips-Young has no criminal history.

The two boys have been placed in foster care.

COLUMBIA, S.C. (AP) – A Columbia woman has been arrested after a 2-year-old boy in her care died last weekend.

Police said Thursday that 34-year-old Margie Hamm had been charged with homicide by child abuse.

Authorities say that Ms. Hamm had her three kids in the bathtub along with her boyfriend’s little boy. Out of anger she slammed the boy’s head into the bathtub faucet. Her three kids were not injured.

Richland County Coroner Gary Watts says the boy was having trouble breathing, but Hamm told authorities she put him to bed anyway.

The boy died overnight. His father got home late from work and found his son unresponsive the next morning.

Emergency workers found no obvious injuries, but the coroner said he saw a mark near the boy’s nose.

Hamm told police the boy had run into a door. She was jailed Thursday, and it wasn’t known if she had an attorney.

William Ellis

CHARLOTTE, N.C. — The man who was originally charged with killing a toddler took the stand Wednesday and singled out the man he says actually pulled the trigger.

Alvin Alexander was arrested the night of the murder and held for more than two months.

He was the main suspect, mostly because of statements by Shariff Baker, one of the men at the center of this case, and other witnesses. Baker said he was afraid of being arrested himself and told police “what he thought they wanted to hear”. In October 2010, Mr. Alexander was released, and Royster was charged in the shooting.

Alexander told jurors that he heard and saw Ellis Royster fire a gun “probably about 10″ times on Aug. 12, 2010.

“It was just pow, pow, pow, pow, pow,” he said. “I seen Ellis shooting, pointing his gun that way, shooting up the street.”

Police said Royster shot at a man driving down Eastbrook Road that he believed had taken his friend Shariff Baker’s money without handing over marijuana.

They said a stray bullet hit 2-year-old Amias Robinson, who was sitting in his stroller nearby with cousins. He was paralyzed and died a few days later.

On Wednesday, prosecutors brought the child’s blood-stained stroller into the courtroom.

“When he hit the curb and I see him fall out of the stroller,” Alexander said, “that’s when I knew I had to leave.”

Alexander said he also left because he had crack on him and was driving his girlfriend’s car without a license.

He said when he was told police were looking for him, he went with them to CMPD’s Law Enforcement Center in Uptown Charlotte. He said they questioned him, then arrested him for the shooting.

Prosecutors played emotional phone calls he made from jail, in which he cried or ranted to family and friends about the arrest. Jurors heard him say several times that Royster did it, not him.

Mr. Royster’s attorney tried to stir up doubt by suggesting that Mr. Alexander also had a gun on him the day of the shooting, the same kind of gun that killed baby Robinson. Mr. Alexander denied that fact.

The attorney also asked Alexander what he expected to receive for testifying.

“Just to clear my name of any wrongdoing in this case,” he said.
