FBI Seeking Armored Truck Employee Robber & Shooter

On Monday morning, a young black male (shown in photos) robbed and shot a female Loomis armored truck employee at the Foxcroft Shopping Center, located off of Fairview Rd in South Charlotte.

The FBI says the armored truck had two employees in it when one of them got out to service the ATM, when the armed robber grabbed a bag of money and shot 47-year-old Ladena Duncan in the shoulder.

After the shooting, the armored car weaved through traffic on its way to the hospital when a 911 operator told them to pull over at the corner of Providence Road and Cavendish Court so Duncan could receive medical attention.

Investigators tracked the robber down a path that runs behind the shopping center, but were not able to find the man. The FBI is hoping surveillance photos are able to help them identify the man. Medic officials said Monday morning Duncan’s injuries were life-threatening but the hospital has not released any information on Duncan’s condition.

Victim Found Dead Inside Home in CMPD University City Division

Case Update: Tuesday, January 24, 2012- The victim in this case has been identified as George Watts, DOB: 08/26/1933.

Detectives with the Homicide Unit have charged Wilbert Sinclair Smith Jr, DOB: 09/05/1979, with Neglect Disable/Elder Serious Injury. Mr. Smith turned himself in to police custody and was transferred to the custody of the Mecklenburg County Sheriff’s Office. Charlotte-Mecklenburg Police Department Homicide Detectives are conducting an investigation in the University City Division, where one person was found deceased. The victim was found inside a residence at 10616 Hellebore Road. The initial call for service was received at 6:52 a.m. on January 21, 2012. The victim has been identified, pending family notification, the name will be released.

University City Division officers responded to the residence in reference to a death investigation. Upon their arrival, officers discovered a person that appeared to be deceased for several days. Detectives are interviewing relatives of the deceased. At this time, it is a suspicious death investigation and not believed to be a random act of violence.

Crime Scene Search responded to the call for service to process the scene and collect physical evidence. The Arson Task Force (CFD, CMPD) is assisting with the investigation. Representatives of the Mecklenburg County District Attorney’s Homicide Prosecution Team responded to the scene as well.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit are conducting a death investigation at 2325 Toomey Avenue in the Central Division. The call for service was reported at 3:58 p.m., on Thursday, January 19, 2012. The victim has been positively identified as Yama Monteith Fluker.

Central Division officers responded to Al’s Mini Mart to an unresponsive male in a vehicle. Upon their arrival, they located the victim in the vehicle not breathing. Detectives are currently canvassing the neighborhood to determine if anyone has information that will aid in the investigation. As additional information develops, it will be released by CMPD Public Affairs.

Fast Wok Employee Robbed & Murdered

Case Update: January 19, 2011- CMPD Homicide Detectives have arrested Briley Belk IV, and charged him with the Armed Robbery and Murder of Mr. Edward Rosen. The Burgundy convertible Chrysler PT Cruiser used in the Robbery/Murder was also located and seized. Detectives are still attempting to identify a second suspect; a black male.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and Robbery Unit are conducting an investigation into the robbery of Fast Wok, which left an employee dead. Fast Wok is located at 7008 East WT Harris Boulevard in the Hickory Grove Division. The call for service came in at 8:17 p.m., on Sunday, January 15, 2012. The victim has been positively identified as Edward Rosen.

Hickory Grove Division patrol officers responded to the Fast Wok in reference to a robbery/shooting of an employee of the restaurant. When officers arrived on the scene they located the victim suffering from an apparent gunshot wound to the chest. The victim was transported to Carolinas Medical Center with life-threatening injuries; he passed away at 9:13 p.m. as a result of his injuries. The suspect in the case is described as a black male, wearing a gray hooded sweatshirt and jeans. The suspect fled the immediate area on foot. The K-9 Unit responded to the scene in an effort to track the suspect but was unable to locate him. As additional information develops in this case it will be released by CMPD Public Affairs.

Police Seeking Bank Robber

CMPD's New Years Eve After-Action Report:

The goal of the Charlotte-Mecklenburg Police Department during the New Year’s Celebration was to ensure that people had a safe environment in which to celebrate the holiday-- in the center city and in Charlotte neighborhoods. Our operations plan for New Year’s Eve was solid and successfully implemented. Partnerships with the Mecklenburg County Sheriff’s Office, the Charlotte Fire Department and MEDIC in particular provided key support for the success of this operation.

CMPD Officers with the Central Division, Civil Emergency Unit and other specialized units were deployed in the center city area. Their efforts were coordinated from the CMPD Command Center. All other patrol divisions were fully staffed to respond to an expected increase in calls for service on New Year’s Eve and the early hours of New Year’s Day.

Arrests:
* Final reports indicate there were a total of 31 adult arrests in the center city area recorded between the hours of 7:00 p.m. on 12/31/2011 through 3:30 a.m. on 01/01/2012.
*19 of the 31 adults arrested reside outside of Mecklenburg County including five that reside in other states.
*16 juveniles were arrested for curfew violations.

Man Shot in Parking Lot of Club Backstage

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit are conducting an investigation into a shooting in the parking lot of club Backstage, located at 8801 East WT Harris Boulevard in the Hickory Grove Division. The incident was reported at 1:58am on Sunday, January 01, 2012. The victim has yet to be positively identified.

Hickory Grove Division patrol officers responded to the club in reference to a shooting which was called in by CMPD officers who were working at the club in a Secondary Employment (off-duty) capacity. The off duty officers were hired by the club’s management to provide security for the New Year’s Eve festivities. In addition to the CMPD off-duty officers, private security was also working the club.

As the club closed for the night, CMPD officers were attempting to clear the parking lot when they heard several gunshots fired in the area of a crowd. When they made their way to the crowd, they found a male subject who had been shot in the head. Once Medic arrived on the scene, the subject was transported to Carolinas Medical Center for treatment, where he is currently in critical/unstable condition.

Man Found Dead Inside Home on Pine Street

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit are conducting a death investigation at 6223 Pine Street in the Freedom Division. The incident was reported at 4:45pm. The deceased has yet to be positively identified.

According to the CMPD, Freedom Division officers responded to a check the welfare call placed by a friend of two adult males who reside at the above residence. The friend stopped by their home and noticed that their door was wide open so she called police to investigate. When officers arrived on scene, they located one of the males inside the residence. He was deceased but not suffering from any apparent signs of trauma. The second male was located highly intoxicated in a back bedroom. The second male subject has been transported to CMPD Headquarters for questioning.

The Mecklenburg County Medical Examiner’s Office will determine the cause of death. Detectives have canvassed the surrounding homes in an attempt to determine if anyone heard or saw anything in the area in the hours leading up to the reported incident that will aid in the investigation. As information develops, it will be released by the CMPD Public Affairs Office. Representatives of the Mecklenburg County District Attorney’s Homicide Prosecution Team responded to the scene as well. CMPD Seeking Financial Crime Suspect

On December 22, 2011 at 18:42 hours, Michael Yashema Byers attempted to send a wire transfer in the amount of $9,400 through the Western Union in the Food Lion located at 5831 South Boulevard. The suspect gave the cashier a stack of bills consisting of 20 and 50 dollar denomination totaling $9,400.

The wire transfer was accepted and the suspect left the scene. The cashier weighed the bills and began to check the bills individually. She discovered that all of the U. S. Treasury notes the suspect gave her were counterfeit notes. The Charlotte Mecklenburg Police Department Financial Crimes Unit identified the suspect and obtained a warrant on Michael Byers. Several attempts have been made to locate and arrest the suspect. He has not been located at this time.

Drunk Woman Evades DWI Checkpoint & Crashes

Denise Garcia, 25, is charged with DWI after a wrong-way collision early this morning at the junction of Independence Boulevard and the Brookshire Freeway. The accident occurred as Garcia tried to evade police, who had set up a sobriety roadblock.

The CMPD said they received several calls around 3am in regards to a silver sedan traveling the wrong way on Independence Boulevard. A short time later, Garcia's car struck a CMPD patrol car and was stopped. Police say they arrested Denise Garcia and charged her with DWI, reckless driving, failure to heed to a blue light/siren and driving with an expired license. Thankfully, no serious injuries were reported

The CMPD will send the phones to a recycling center in Florida and all proceeds will go directly to the Charlotte Battered Women’s Shelter.

Guns Stolen from Panthers Player's Car in Best Buy Parking Lot

Panthers Linebacker Kion Wilson (#91) reported to police that someone took four guns from his Ford F-250 pick-up truck in the Best Buy parking lot around 5:12 p.m. on December 26. The location of the Best Buy is 10221 Perimeter Parkway.

Wilson reported that his Glock 23, FN Five-Seven, Smith & Wesson Bodyguard 380 and Mossberg 12 gauge shotgun were all taken from his truck. The report also stated he had damage to the door lock on his truck.

Homicide Detectives Conducting Investigation in Freedom Division

Charlotte-Mecklenburg Police Department Homicide Detectives are conducting an investigation in the Freedom Division. According to police, this incident was a domestic homicide where a husband shot his wife to death at 2024 Pheasant Glen Road. The victim has been identified as Catherine Elizabeth Ahern Blakeney.

The suspect, Brandon Oneal Blakeney has been charged with murder and is the Mecklenburg County Jail.

Freedom Division officers responded to the residence in reference to a check the welfare call for service. Upon their arrival, they were greeted by the suspect, who allowed the officers in to look for the victim. While conducting a search of the residence, the victim was located deceased. The suspect was taken into custody and transported to the Law Enforcement Center for questioning.

CMPD is seeking a man who robbed a gas station earlier this month near Woodlawn Road. According to police, they are looking for a white man that is approx. 5'7" and 170 pounds. He was last seen wearing a black puffy coat, a black toboggan and he was armed with a black handgun.

Six Men Plot Home Invasion/Extortion Attempt in Jail Cell

We never heard any reports by any media outlet of a home invasion and extortion attempt by six Charlotte men in May-- who happened to hatch the plot of in the Mecklenburg County Jail. According to a Charlotte Observer article, it happened!

Roderick Hardin, Tim Donahue, Leo McIntyre, Otis Sutton, and brothers Abdul and Osman White are charged with robbing a business that engages in interstate commerce, which is a federal crime.

According to court documents, Osman White came up with the plan to rob the owner of the car dealership/junkyard, who was believed to have $1 Million in a safe inside his house. White shared his plan with McIntyre and Hardin, while the men were housed in pod 3700 in Mecklenburg's uptown jail in May.

The target of the plot owns a junkyard and also sells used vehicles and parts, and he buys and receives vehicles from auctions across the Southeast. The business also ships car parts throughout the United States and Puerto Rico, according to an affidavit sworn Tuesday by Rodney Blacknall, an agent with the federal Bureau of Alcohol, Tobacco Firearms and Explosives. The owner, who wasn't named in court documents, lived in a home located on the same property. He told investigators that he'd been storing money from his business in a safe in his home for years.

On July 21, the target and his children were inside the home in Mooresville. A car pulled into the driveway, and two men - later identified as Hardin and Sutton - asked about buying one of the cars for sale at the edge of the property. As the men were talking to the victim, court documents say, two of the other suspects pulled out a shotgun, demanding money from the victim and ordering the family into the home.

Once the family was inside the home, one of the suspects demanded that the victim give him money from a safe inside the home, according to the documents. The suspect told the victim that he would shoot the children if he did not get the money. The victim led the man with the gun to a safe in the home, authorities said, while another suspect used rope to tie up the children and another adult in the house.

But court papers say the plan began to unravel a few days after the robbery, when a confidential informant contacted law enforcement. The confidential informant said one of the suspects told him about the robbery and how they had "gotten so much money that he had to rent a storage unit" off Monroe Road to store it all. Law enforcement agents confirmed that Hardin had rented the site using his passport as identification. Agents arrested Hardin when he arrived at the storage unit, seizing $5,000 from him and more than $550,000 from inside the unit.

Two Midwives Charged after Infant Death

Charlotte-Mecklenburg Police Department Homicide Detectives have arrested and charged Mary Stewart Barhite and Jacqueline Lynn Proffit, with practicing midwifery without a license (NCGS 90-178.3(a). North Carolina Statute states that in order to practice midwifery, one has to be board-certified as a registered nurse.

On December 16, 2011, at 7:59 p.m., Steele Creek Division officers responded to an Assist Medic call on Seamill Road. Upon officers and Medic’s arrival, they located an unresponsive newborn. It appeared that the mother participated in a water birth at home and there were complications; CPR was initiated and Medic transported the infant to Carolinas Medical Center for treatment. A short time later, the infant was pronounced deceased by medical personnel.

Homicide Detectives were contacted and responded to the residence and the hospital. While detectives were conducting their investigation, it was revealed two females that were in the residence during the time of the birth; practicing midwifery without a license. However, they did not have the proper license as required by North Carolina law.

Crime Scene Search responded to the scene to photograph it and collect physical evidence. The Charlotte-Mecklenburg Homicide Unit responds to all infant deaths and conducts an investigation to ensure a successful conclusion.

On Thursday, December 22, 2011, Charlotte-Mecklenburg Police Officer Marty Cuthbertson will be distributing Crime Stoppers information to the community at the corner of Tom Hunter Road and Canterwood Drive in response to several residential B&E’s in the area.

Officer Cuthbertson coordinates the Charlotte-Mecklenburg Crime Stoppers program and 2011 was an historic year for the program. More than 1750 tips were received this year that resulted in roughly 225 arrests. The individuals arrested ranged from property thieves to murderers.

The Crime Stoppers program also paid out a record $34,360 dollars to tipsters, recovered nearly $70,000 in stolen property and 21 weapons.

CMPD Officer Presented with Law Enforcement Commendation Medal

Chief Rodney Monroe, Officer Roth & ?

Officer Wayne Roth was presented with the Law Enforcement Commendation Medal by the Mecklenburg Chapter of the North Carolina Society Sons of the American Revolution. Each year this award is given to recognize exceptional service by an officer who made major contributions to our community.

Officer Roth is assigned to the Freedom Division field services and has been with the department since 2005.

Officer Roth has been a member of the Civil Emergency Unit for his entire career and has volunteered for deployments to Washington, DC for the presidential inauguration and to Pittsburgh for the G-20 Summit. He has been selected to attend specialized training to include the Justice Academy and the Center for Domestic Preparedness in Anniston, Alabama. He currently assists with officer driver training and is one of the instructors for training in preparation for the national convention in Charlotte in Sept 2012.

Officer Roth is a veteran and retired after 20 years of service as a 1st sergeant in the 82nd Airborne Division. He has been awarded three Bronze Stars and the Purple Heart. He is an avid runner and participates in charity runs for cancer and Alzheimer’s disease research.

Fifty-three (53) defendants plead guilty in Mecklenburg County Superior Court before The Honorable Beverly T. Beal and The Honorable Robert C. Ervin, Superior Court Judges. The defendants entered their guilty pleas from Monday, December 12 - Friday, December 16, 2011. Among them were:

Michael Washington, 35, plead guilty to four (4) counts of first degree sexual offense on a child. Washington was sentenced to 204-254 months in prison.
Reginald Hoover, 49, plead guilty to three (3) counts of sexual activity by a substitute parent. Hoover was sentenced to 99-147 months in prison.
Gerald Sykes, 38, plead guilty to robbery with a dangerous weapon. Sykes was sentenced to 59-80 months in prison.
Damiyon Sanders, 18, plead guilty to robbery with a dangerous weapon. Sanders was sentenced to 51-71 months in prison.
Jarvis Wilson, 18, pled guilty to 1) robbery with a dangerous weapon, 2) attempted robbery with a dangerous weapon, and 3) conspiracy to commit robbery with a dangerous weapon. Wilson was sentenced to 44-62 months in prison.

Man Shoots Roommate and Self on Donna Drive

Charlotte-Mecklenburg Police Department Homicide Unit Detectives are conducting an investigation which left one person deceased. The victim was found inside a residence at 6208 Donna Drive. The victim has been identified as Stephanie Ott.

The initial call for service came into the Charlotte-Fire Department and North Tryon Division officers were assisting with a possible forced entry into the residence. Once entry was made, the victim was found deceased. Based on their observations, they requested CMPD Homicide Detectives. At this preliminary stage, it appears the fire was intentionally set. As a neighborhood canvass was being conducted the suspect was located in a storage shed in the backyard of 6234 Donna Drive. The suspect, Robert Stover, barricaded himself in the shed for a brief period of time before he fatally shot himself.

Crime Scene Search responded to the scene to photograph it and collect physical evidence. The Fire Investigations Division, Homicide Unit, ADW, Arson, and the Gang Unit and a representative from the Homicide Prosecution Team responded to the scene to aid in the investigation.

Anonymous E-mail Makes CMPD 'Fess Up about Releasing Rape Suspect

The following email was sent to the Cedar Posts blog and every news outlet in Charlotte early this morning. Shortly before noon, CMPD announced a press conference at 3pm to discuss the "real story" of how they let a rape suspect go unmonitored, only for him to rape a 3rd woman...

The information you have received from CMPD concerning the arrest and actions of Lavantae Evans is not completely true. They have lied in an effort to cover up their mistakes which lead to an innocent person being sexually assaulted and held against her will.

Police responded to the Sunset Inn at 5301 Equipment Dr around 6 a.m. on 12/15/2011. During this altercation Evans was named and positively identified as a suspect in the kidnapping and rape of two female subjects. Evans was found hiding in another hotel room a few doors down from where the assault took place. Once Evans was located he was positively identified as the person who raped and kidnapped the two women. He was then voluntarily transported to the Law Enforcement Center to be questioned by detectives.

At some point Evans was allowed to leave police custody and not charged with the rape and kidnapping of the first two women. After being allowed to leave police custody he then kidnapped and raped another woman which led to the police standoff with the SWAT team responding. It was only after Evans was involved in the raping and kidnapping of a third woman that detectives went and obtained warrants for his arrest for the first two women that he assaulted.

CMPD completely failed in this incident and allowed a dangerous, violent and disturbed individual to walk the streets and a few hours later lead to the rape of another woman that could have been completely prevented.

Please, I implore you to dig harder and see that the information released to you by CMPD is not true in its entirety. All that I have said is documented and available for public record. Please look more into this story and report the truth about what happened with Mr. Evans and CMPD's failure to protect this community.

Man Shot & Killed in North Division

UPDATE: After consultation and reviewing the evidence with the Mecklenburg County District Attorney’s Office, Homicide Detectives with the Charlotte-Mecklenburg Police Department have determined that no charges will be filed against the property owner and that his actions did not rise to the level of criminal conduct in the shooting death of James David Lambert.

During the course of the investigation, CMPD detectives determined that the property owner positioned himself between his car and the truck James David Lambert was operating in an attempt to detain Mr. Lambert until police arrived. Evidence gathered indicated that Lambert accelerated his vehicle in the direction of the property owner presenting a reasonable fear of imminent death or serious bodily harm to the property owner.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and A/D/W Unit are conducting an investigation into a shooting which left one man dead near the intersection of Lawing School Road and Mt. Holly-Huntersville Road. The incident was reported at 11:43 pm on Monday, December 12, 2011. The victim has been positively identified as James David Lambert.

CMPD North Division Officers initially responded to a larceny call for service in reference to a pick-up truck stealing a trailer on Travis Floyd Lane. Initial evidence indicates that a resident on Travis Floyd got into his truck to go after the suspected thieves. At the intersection of Lawing School Road and Mt. Holly-Huntersville Road the resident fired a gun and as a result James Lambert was shot in the head.

Lambert was transported to Carolinas Medical Center, where he was pronounced deceased shortly after arrival. The second occupant of the vehicle towing the trailer remained on scene and has been transported to police headquarters, along with the shooter, who also remained on scene. This investigation is in its early stages. Detectives are in the process of canvassing the area of the initial call for service on Travis Floyd Lane. Representatives of the Mecklenburg County District Attorney’s Homicide Prosecution Team responded to the scene as well to aid in the investigation.

Man Convicted of Involuntary Manslaughter for Killing Three Street Racing

Tyler Stephen Stasko, 23, was tried for three counts of second-degree murder for the April 4, 2009, car wreck that killed 45-year-old Cynthia Furr, her 2-year-old daughter McAllister Price, and Stasko’s passenger, 13-year-old Hunter Holt.

On December 13, 2011, after a six-day trial, a jury found Stasko guilty of three counts of involuntary manslaughter, a lesser included charge of second-degree murder. The Honorable James W. Morgan, Superior Court Judge, sentenced the defendant to 15-18 months in prison for each charge, to run consecutively, for a total of 45-54 months.

On the evening of April 4, 2009, the defendant, with two passengers in his car, began racing at the intersection of York Road and Shopton Road with a black Camaro. Witnesses testified that the two cars reached speeds of 100 MPH while racing south on York Road. The defendant slammed into Cynthia Furr’s car as she pulled out of her subdivision at the intersection of York Road and Riverpointe Drive. A crash reconstruction by CMPD showed that the defendant was going at least 86 MPH when he hit Cynthia’s car.

The call for service was reported at 2:27 p.m., on December 11, 2011. The victim has been identified as Chaple Bernard Waymyers.

North Tryon Division officers responded to Commercial Avenue to investigate the report of a person shot. When officers arrived on scene, they located a black male subject suffering from an apparent gunshot wound; he was pronounced deceased on scene. Based upon initial information, this is not a random act of violence; the victim and suspect were known to each other.

The victim was in a motorcycle club meeting when the suspect entered the building firing his weapon at the victim, striking him. All witnesses are cooperating with the investigation and are providing statements.

Man Wanted for Cutting off Electronic Monitoring

Alquez Lee Thompson is wanted by the Violent Criminal Apprehension Team (VCAT) on outstanding warrants for interfering with an electronic monitoring device, possession of a handgun by a minor and carrying a concealed weapon. Thompson was on CMPD Electronic Monitoring while out on bond for pending charges. On December 8, 2011, Thompson cut off his court ordered monitor and is currently on the run.

Thompson has an extensive criminal history including 16 arrests in Mecklenburg county including assault with a deadly weapon, felony drug and felony weapon charges. Thompson should be considered Armed and Dangerous. CMPD Officer Arrested for Assault on DWI Suspect

UPDATE: On Wednesday December 21, 2011, the Charlotte-Mecklenburg Police Department suspended Officer David Jones III without pay and cited him for termination from the department as the result of an internal investigation. The recommendation for this action was the outcome of an Independent Chain of Command Review Board which examined the information gathered during the internal investigation.

The investigation was launched following a December 7, 2011, incident in which Jones was accused of assaulting an individual. There is still an active criminal investigation being conducted by Matthews Police Department concerning the incident.

On Friday, December 9, 2011, an arrest warrant was obtained for Charlotte-Mecklenburg Police Officer David Jones III. Jones was charged with assault inflicting serious injury.

It has been alleged that Jones assaulted Richard McVicker who struck the vehicle of a family member of his during a motor vehicle collision on December 7, 2011 in Matthews. The individual who Jones is accused of assaulting was treated at a local hospital and was arrested and charged with DUI upon his release. Rick McVicker, the man he allegedly assaulted, is charged with DWI.

Jones turned himself in to the Magistrates Office this afternoon and is in the custody of the Mecklenburg County Sheriff’s Office.

Court Proceedings Will Stop During DNC 2012

When the Democratic National Convention (DNC) 2012 comes to Charlotte next September, the state court process will stop and there will not be any criminal or civil trials during that time.

"Most officers will be on the street during the convention," District Attorney Andrew Murray, said. "We won't have police officers available that week as witnesses to try cases."

Police will be busy providing security when an estimated 35,000 people descend on our city. The visitors will include delegates, protesters, supporters and 15,000+ journalists.

At the federal courthouse uptown, court officials aren't postponing all trials because of the convention but they plan to limit the number of hearings because of the difficulties the security measures surrounding the convention may pose for litigants, jurors and witnesses to get to the courthouse.

The Democratic National Convention will be held at the Time Warner Cable Arena during the week of Sept. 3, 2012.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit are conducting an investigation into a shooting which left one man dead. The victim was struck by gunfire and collapsed in the front yard of 4617 Willard Street, in the Freedom Division. The call for service was reported at 2:16 p.m., on Thursday, December 08, 2011. The victim has been identified as Craig Allen Leverette Jr.

Freedom Division officers responded to an A/D/W call for service in reference to a male subject who had been shot. When officers arrived on scene, they located Mr. Leverette lying in the front yard of 4617 Willard Street; Mr. Leverette had no previous connection to this address. Based upon initial witness statements and evidence gathered along Willard Street, multiple gunshots were fired near the intersection of Lewiston Avenue and Willard Street.

As additional gunshots were fired, the incident proceeded up Willard Street towards Marble Street. Mr. Leverette was struck by gunfire and collapsed as he ran along Willard Street. Mr. Leverette was transported to Carolinas Medical Center, where he was pronounced deceased shortly after arrival.

Detectives are canvassing the area in an effort to determine if there are additional witnesses. This is not a random act of violence; Detectives believe that those involved in this shooting were previously known to each other. Former Car Dealer Sentenced for Embezzlement Charges

On December 5, 2011, Reginald Timothy Hubbard, 58, was convicted of 11 counts of Aiding and Abetting Embezzlement of State Property, 12 counts of Aiding and Abetting Obtaining Property by False Pretenses, and Malfeasance of a Corporate Agent.

Reginald Hubbard is the former President and Owner of Hubbard Automotive, LLC d/b/a Honda of Lake Norman in Huntersville, NC. He was investigated by the N.C. Department of Motor Vehicles (“DMV”) for collecting license, title and registration fees from customers, but not turning these fees over to the DMV.

Additionally, he condoned the dealership’s practice of accepting trade-in vehicles without paying off the outstanding lien. Instead of paying the balance owed on the vehicle, the defendant sold the car to a new purchaser without having a valid title.

The Honorable Linwood O. Foust sentenced the defendant to three consecutive sentences of 13-16 months in prison (total of 29-48 months). Those sentences were suspended pending his successful completion of at least 18 months of supervised probation with the requirement that he complete 50 hours of community service and pay full restitution to all of the victims. The defendant must also serve 11 months in the county jail as a condition of probation.

Prior to pleading guilty, the defendant paid $30,500 in restitution and will continue making restitution payments while on probation. All of the outstanding liens have been paid off, and titles have been transferred to the rightful owner. After discussions with many of the victims, it was determined that one of the primary goals of the prosecution should be obtaining restitution for those who were suffering a financial hardship that resulted from the defendant’s conduct.

FBI Warns Charlotteans of Phishing Scam

A new phishing scam is targeting people in the Charlotte, NC area according to the Charlotte division of the FBI: An e-mail that appears to be from the National Automated Clearing House Association alerts recipients to a problem with a direct deposit transaction at their banks and says it was not processed. The email advises recipients to click a link to enter the secure section of a website, but instead launches a virus that can monitor keystrokes and steal online banking credentials, the FBI said.

Once an account is compromised, the hackers attack the financial institution as a distraction while they send fraudulent wire transfers to jewelry stores, officials said. Then, the FBI says, couriers pick up the jewelry "electronically," paid for using money from hacked accounts.

The FBI Charlotte Cyber Squad said users shouldn’t clicks links in emails from someone they weren’t expecting an email from. If consumers ever receive an email alert about a problem with bank accounts, they should call the bank directly, officials said.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and ADW Unit are conducting an investigation into a stabbing which left one woman dead outside of Hartigan’s Irish Pub. The initial incident took place inside Hartigan’s and spilled over into the common area outside the pub, at 601 South Cedar Street in the Central Division. The call for service was reported at 2:21am.

Central Division officers responded to an A/D/W call for service in reference to multiple female subjects who had been fighting, one of whom had been cut. When officers arrived on scene, they located the victim lying unresponsive in the common area outside the pub near the parking lot. Based upon initial witness statements, the victim and several other women were inside a bathroom at Hartigan’s and a fight broke out. Witnesses stated that the fight carried over to the common area outside the pub where the victim was stabbed with a broken beer bottle.

The victim was transported by Medic to Carolinas Medical Center where she was pronounced deceased shortly after arrival. The suspect in the stabbing remained on scene and has been transported to police headquarters along with multiple witnesses. The call for service was reported at 11:44 pm. on Wednesday, November 30, 2011.

Providence Division officers responded to the EconoLodge to investigate the report of a person shot. When officers arrived on scene, they located a Rea in the parking lot suffering from an apparent gunshot wound. Medic pronounced the victim deceased on scene. Based upon initial statements, the Metro Special Police were patrolling the grounds when they heard gunshots and located the victim. Woman Killed by Hit & Run Accident - Driver Arrested

UPDATE: The CMPD Major Crash Investigation Unit received information about the driver and vehicle involved in this collision on 11/19/2011. This information led to the arrest of Amber DeJesus. She was subsequently charged with Felony Hit and Run and possession of drug paraphernalia.

A woman was crossing the 5900 block of Monroe Road when she was struck by a vehicle that was headed inbound toward downtown Charlotte. This vehicle left the scene without leaving any information or rendering aid to the victim. The victim has been identified as Valerie Miranda.

Medic arrived at the scene and pronounced the victim deceased. The CMPD Major Crash Investigation Unit responded to the scene and is conducting the investigation. The information gathered at the scene indicates the suspect vehicle could be a dark colored pick-up truck with dually rear wheels. This vehicle could have damage to the right front headlight assembly and right front corner.

Armed Robbers Tie up Employees During Store Robbery

Two teenage girls and two adults were working at the La Providencia grocery store when it was robbed at gunpoint Monday night.Charlotte Mecklenburg Police were called to the store at 809 East Arrowood Road near South Boulevard around 11pm.

The employees told police two people with guns came into the store and locked the front doors before pointing their guns at them, demanding money. Police said one of the employees was dragged by her hair and forced to go into a back room with one of the gunmen. Another employee reported they were tied up.

The robbers took $50,000 in cash and a cell phone. According to a police report, the two gunmen ran out the back door to the business.

CMPD's Homicide Detectives are currently conducting an investigation into a shooting that occurred in the CMPD South Division on Dianthus Court. The victim has been identified and his name will be released once family notification is made.

At 5:43pm, CMPD Officers arrived on scene and located a male subject suffering from an apparent gunshot wound. Medic transported the victim to Carolinas Medical Center-Pineville for treatment. A short time later, the victim succumbed to his injuries and was pronounced deceased by physicians.

The other individual involved has voluntarily been transported to the Law Enforcement Center for questioning and is cooperating fully with detectives. This is not a random act of violence; both parties are known to each other.

Intoxicated Man Charged with Murder after Accident

Early this morning, Eric Cox, a driver of a Chevrolet Tahoe, was driving east on E. Sugar Creek Road at a high rate of speed and entered the intersection of The Plaza while the traffic light in his direction was showing red. As he crossed the intersection, he struck a Nissan Altima in the left side. Both vehicles slid through the intersection and came to rest in the southeast corner of the intersection.

The driver of the Nissan, H’Luon Sin, died at the scene from her injuries, and her 4-year old son was transported to the hospital with life-threatening injuries. He is currently listed in critical but stable condition.

Eric Cox was not injured in the crash and he was arrested for DWI at the scene. He was later charged with the listed offenses. Mr. Cox had an alcohol concentration (.04) restriction on his North Carolina driving record from a previous DWI conviction. He has been transported to the Mecklenburg County Jail.

On Wednesday, November 23, 2011, at approximately 4:40 p.m., the shown suspect entered the RBC Bank branch located at 1000 East Blvd. and pretended to be a customer. The suspect then approached one of the tellers and demanded money.

The suspect obtained cash and fled on foot. There was no weapon seen and no injuries occurred as a result of the robbery. The suspect description is:

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and ADW Unit are conducting an investigation into a shooting near the 900 block of Ambassador Street in the Metro Division, which left one person deceased. The call for service was reported at 10:37 p.m., on November 24, 2011. The victim has been identified as Justin Glenn.

Metro Division officers responded to Ambassador Street to investigate the report of a person shot. When officers arrived on scene, they located a black male subject suffering from an apparent gunshot wound; he was pronounced deceased on scene. Based upon initial information, this is not a random act of violence. The victim and suspect were meeting to conduct a drug transaction, when a brief altercation occurred and the suspect fired a weapon striking the victim. All witnesses have been transported to the Law Enforcement Center to provide statements.

Two Killed & Three Arrested for Murder and Armed Robbery

The Charlotte-Mecklenburg Police Department Homicide Unit is conducting an investigation that occurred in the Freedom Division. The call for service was reported at 6:45 p.m. on November 21, 2011. The victims have been identified as Benjamin Acahua-Itehua and Floriberto Acahua-Itehua.

CMPD Freedom Division officers responded to a Missing Persons call for service near the 11200 block of Mt. Holly Road. The caller advised that he had not seen or spoken to his cousin in several days.

When officers arrived at the residence, they located evidence that was consistent with foul play. Another complainant arrived at the residence to check on his employee who had not shown up for work.

The officers then contacted Missing Persons and Homicide Unit detectives to take the lead on the investigation. Based upon information developed during the course of the investigation, there was missing property, including vehicles that belonged to the victims. Detectives canvassed the neighborhood to follow any leads and additional information.

Upon further investigation, suspects were developed and a BOLO (Be On the Look Out) was sent out to surrounding agencies. Within a short time period, three suspects were apprehended; Aquilino Tzompaxtle, Dominick Vershon Cole and Efrain Tzompaxtle. This is not a random act of violence; the victims and suspects were known to each other.

Thirty-four defendants plead guilty in Mecklenburg County Superior Court before The Honorable Robert C. Ervin, Superior Court Judge. The defendants entered their guilty pleas between Monday, November 7th - Thursday, November 10, 2011.

Among those to plead guilty were:
Gennadiy Rizhkov, 31, plead guilty to second degree sex offense. Rizhkov was sentenced to 44-62 months in prison.

Renee Portillo, 22, plead guilty to taking indecent liberties with a child. Portillo was sentenced to 10-12 months in prison.

Terry Clay, 21, plead guilty to assault with a deadly weapon with intent to kill. Clay was sentenced to 26-41 months in prison.

Andre Staton, 22, plead guilty to possession of a firearm by a convicted felon. Staton was sentenced to 13-16 months in prison.

Keshia Newton, 28, plead guilty to conspiracy to commit common law robbery. Newton was sentenced to 10-12 months in prison.

Student Brings Gun to Hidden Valley Elementary School

Six Habitual Felons Sentenced to Prison Terms

The Mecklenburg County District Attorney’s Habitual Felon Team called six cases for trial the week of November 14, 2011. The trials were held before the Honorable Yvonne Mims Evans, Superior Court Judge, Honorable Linwood O. Foust, Superior Court Judge, and the Honorable Richard D. Boner, Senior Resident Superior Court Judge.

John Mayhew, 31, was tried for 1) possessing with intent to sell or deliver cocaine, 2) selling cocaine, 3) delivering cocaine, and 4) being a habitual felon. The jury found Mayhew guilty of selling cocaine, delivering cocaine, and being a habitual felon. Judge Evans sentenced Mayhew to 98-127 months in prison. Some of Mayhew’s prior convictions include embezzlement, felony breaking or entering, larceny after breaking or entering, and assault on a female.

Terrell Williams, 22, was tried for 1) felony breaking or entering, 2) felony conspiracy, and 3) being a habitual felon. The jury found Williams guilty of both felony breaking or entering and conspiracy, and he admitted his status as a habitual felon. Judge Boner sentenced Williams to 88-115 months in prison. Some of Williams’ prior convictions include multiple counts of felony breaking or entering, larceny after breaking or entering, larceny of a motor vehicle, and possession of a stolen vehicle.

Wesley Davis, 57, was tried for 1) felony breaking or entering and 2) being a habitual felon. The jury found Davis guilty of felony breaking or entering and he admitted his status as a habitual felon. Judge Foust sentenced Davis to 76-101 months in prison. Some of Davis’s prior convictions include uttering a forged instrument, breaking or entering a motor vehicle, larceny of a motor vehicle, assault on a government officer, as well as convictions in federal court.

George Thompson, 40, was called for trial and changed his previous plea of not guilty to guilty as charged to 1) possessing a stolen vehicle and 2) being a habitual felon. Judge Boner sentenced Thompson to 117-150 months in prison. Some of Thompson’s prior convictions include robbery with a dangerous weapon, assault with a deadly weapon, multiple counts of felony breaking or entering, assault on a female, and communicating threats.

Maurice Patton, 36, was called for trial and changed his previous plea of not guilty to guilty as charged to 1) two counts of possessing with intent to sell of deliver cocaine, 2) two counts of selling cocaine, 3) one count of delivering cocaine, and 4) being a habitual felon. Judge Evans sentenced Patton to 114-146 months in prison. Patton has in excess of thirty prior felony convictions including multiple counts of breaking or entering.

Carlos Phillips, 32, was called for trial. During jury selection, Phillips changed his previous plea of not guilty to guilty as charged to 1) possessing a firearm by a convicted felon, 2) possessing with intent to sell or deliver marijuana, 3) possessing of drug paraphernalia, and 4) being a habitual felon. Judge Boner sentenced Phillips to 88-115 months in prison. Some of Phillips’ prior convictions include robbery, larceny of a motor vehicle, assault on a female and felony drug charges.

Sex Offender on Electronic Monitoring Charged with Rape

It is my opinion that some criminals cannot be stopped nor rehabilitated! For example, 38-year old Jason Lamont Miller. He is a registered sex offender and on electronic monitoring who is accused of raping a woman in the early morning hours Wednesday on North Graham St.

Thankfully, the victim noticed the suspect was wearing an ankle bracelet so her testimony is the only reason why he was apprehended quickly.

According to a Charlotte Observer article, Miller had been released from prison in 2010 after serving two years for taking indecent liberties with a minor, and was being monitored by authorities there, said Capt. Mike Smathers, who oversees the department's robbery and sexual assault unit.

The call for service was reported at 7:02 pm, on Wednesday, November 16, 2011. The victim has been positively identified as Bridgette Nicole Evans. Sadly, Evans has appeared on this website several times due to her history of prostitution arrests.

Metro Division officers responded to a Person Down call for service in reference to a woman who was found lying on the ground behind a business. When officers arrived on scene, they located the victim lying unresponsive in the parking lot. Medic transported her to Carolinas Medical Center where she was pronounced deceased at 8:07 p.m. Based upon initial statements, witnesses saw a woman lying on the ground and went to a nearby business to call 911 and report the incident.

Detectives are currently following up on leads and will continue to canvass the area in the coming hours to determine if anyone saw or heard anything in the area that may be related to this investigation. The incident took place in the parking area outside of 7228 Wallace Road, in the Independence Division. The call for service was reported at 12:05 am. The victim has been positively identified as Mikal Lee Legrande.

Independence Division officers responded to an A/D/W call for service in reference to a man who had been shot. When officers arrived on scene, they located the victim lying unresponsive in the parking lot; he was pronounced deceased on the scene. Based upon initial witness statements, the victim and a friend came to the apartment complex to meet another subject.

Witnesses stated that the victim was outside in the parking lot when they heard a gunshot. When they went outside to see what had happened, they found the victim lying in the parking lot suffering from an apparent gunshot wound. Detectives are currently following up on leads provided by residents of the complex. Detectives will continue to canvass the complex in the coming hours to determine if anyone saw or heard anything in the area that may be related to this investigation.

Man Tried and Convicted of Killing Landlord

Shawn D. Howard, 29, was tried for first-degree murder and discharging a firearm into occupied property, for the 2008 shooting death of Jacob Massachi, 53. Today, the jury returned verdicts of guilty as charged.

The Honorable Richard D. Boner, Senior Resident Superior Court Judge, sentenced the defendant to life in prison without the possibility of parole, plus 25-39 additional months in prison.

On the afternoon of July 29, 2008, Mr. Massachi, the defendant’s landlord, was sitting in his work van in front of the defendant’s residence, preparing to leave for the day. The defendant, who was being evicted from the residence that same day, approached the van with a shotgun and fired one shot at Mr. Massachi from close range. Multiple eyewitnesses were present when the murder occurred. The defendant fled the scene but was apprehended by Charlotte-Mecklenburg police officers that evening.

7/16/11- At 2:21am, Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit began conducting an investigation into a shooting which left two people dead in the parking lot of 6520 Four Seasons Lane.

The homicide victims have been positively identified as Jorge Luis Morales and Olivia Raquel Martinez-Mercado.

'VEHICLE OF INTEREST'

CMPD Hickory Grove Division officers responded to the parking lot of the Four Seasons Apartments to investigate the report of a shooting. When officers arrived on scene, they located a female and a male inside a Jeep SUV.

The male victim was pronounced deceased on scene by Medic shortly after their arrival. The female victim was transported by Medic to Carolinas Medical Center, where she succumbed to her injuries at 3:24 am.

Based upon initial witness statements, multiple gunshots were fired in the parking lot. A black SUV occupied by at least one black male was seen leaving the complex heading towards Albemarle Road; in addition, a black male was seen running from the scene of the shooting also towards Albemarle Road.

Woman Raped by Man off Sugar Creek Rd

According to a news report by WBTV News, a man is still on the loose after raping a Charlotte woman as she walked into her home off Osceola Lane, which is near West Sugar Creek Road around 8:30 pm.

A man with a knife in his hand ordered her to get inside her house and get on the ground, the report stated. The suspect then raped her, took her car keys, $60 in cash and a laptop valued at $500, according to CMPD.

The rape occurred in the Potter Glenn neighborhood. Police only have a vague description of the suspect and said he's a black male. The incident took place in the parking area outside of 8110 Runaway Bay Drive at 9:00 pm on Thursday, November 10, 2011. The victim has been positively identified as 50-year old Catherine Barca.

Independence Division officers responded to a call for service in reference to a woman who was found lying unresponsive in the parking lot, was naked from the waist down and severely beaten over the head. She was pronounced deceased on the scene. Cathy Barca lives approx. four miles from where Wright dumped her body.

Detectives are currently following up on leads provided by residents of the complex. CPCC Student Robbed near Central Campus

CPCC's Security & Emergency Management Department is reporting that on Tuesday, November 8th at approximately 1 pm, a CPCC student was the victim of an off-campus robbery along Elizabeth Avenue near the CPCC Central Campus.

During the incident, two suspects reportedly took the student’s personal property by force. The victim suffered an injury and was transported to a local hospital for evaluation. The suspects are described as two black males- one was wearing a black coat and the other wearing a black hoodie.

Man Sentenced to 35 Years in Prison for Murder

Jamarr Springs

Jamarr Tremayne Springs, 29, plead guilty to the murder of Pamela Garmon and other related charges. The Honorable F. Lane Williamson, Superior Court Judge, imposed a consecutive sentence that totals 425 to 580 months (35-48 years) in prison.

Ms. Garmon was shot and killed by Springs on December 1, 2010 at approximately 10:30 pm in a home they shared. Jamarr Springs chased Ms. Garmon through their home shooting at her as many as twenty times with an assault rifle. Ms. Garmon died as a result of multiple gunshot wounds.

After killing Ms. Garmon, Springs fled to North Lake Mall where he shot at two mall patrons and kidnapped a third who was later released unharmed.

Wanted by CMPD: Tomonta Simmons

Tomonta Simmons

Tomonta Simmons is wanted by the Violent Criminal Apprehension Team (VCAT) for outstanding warrants for interfering with an electronic monitoring device. Simmons was released from jail on December 18, 2010 and placed on probation with the NC Department of Community Corrections and he was being monitored by CMPD.

On November 9, 2011 Simmons cut off his court ordered monitor and is currently on the run. Simmons was last seen in the area of I-277 and I-77.

Tomonta Simmons has previously been arrested for felony drug and weapon charges in Mecklenburg County.

Anyone with information on Simmons whereabouts should immediately contact the Violent Criminal Apprehension Team (VCAT) at (704) 336-VCAT or call 911.

CMPD and the NC Department of Community Corrections are involved in a pilot program to monitor priority offenders on probation. Simmons is the second offender to cut off a CMPD electronic monitor as part of this pilot program which is in its second year.

This system test is the first of its kind designed to broadcast a nationwide message to the American public. In the history of the country, nothing like it has been conducted on such a level. As you may be aware, there have been tests in the past, but not of this magnitude encompassing all regions of the United States simultaneously. The three (3) minute test will run concurrently on all radio and Television band stations exceeding the previous messages broadcast which were anywhere from a 30 second to 1 minute message.

The test message on TV may not indicate that it is just a test. This lack of an explanation concerning the message might create confusion. Please share this information with your friends and family so they are aware of the scheduled test!!

Male Body Found Floating in Pond in South Charlotte

Earlier today, the Charlotte-Mecklenburg Police were called to the Carolina Pavilion Shopping Center when a someone noticed a dead body floating in a retention pond on the property, located approx. 200 yards from Kohl's on the far side of the shopping center.

CMPD Search and rescue crews responded to the Carolina Pavilion Shopping Center (off I-485) at 9500 South Boulevard shortly before 2:00 pm to retrieve the body but police are not ready to release the male victim's name nor the exact cause of death.

23 Habitual Felons Sentenced to Prison

The Mecklenburg County District Attorney’s Habitual Felon Team prosecuted 23 felons in the Mecklenburg County Superior Court from November 1-4, 2011. All of the defendants plead guilty and were given prison sentences. The cases were heard before The Honorable F. Lane Williamson, Superior Court Judge. Among those convicted were:

Paulnique Eli Earl, 20, plead guilty to 1) felony larceny of a motor vehicle and 2) being a habitual felon. Earl was sentenced to 50-69 months in prison.

Brandon Howard, 23, plead guilty to 1) six counts of felony breaking or entering a motor vehicle, 2) five counts of financial card theft, and 3) being a habitual felon. Howard was sentenced to 76-101 months in prison.

Calvin Scott, 39, plead guilty to 1) felony breaking or entering a motor vehicle and 2) being a habitual felon. Scott was sentenced to 87-114 months in prison.

Ladante Hudson, 29, plead guilty to possession with intent to sell or deliver cocaine within 1000 feet of a school; he was sentenced to 38-55 months in prison.

Allen Lowery, 52, plead guilty to 1) felony breaking or entering and 2) felony larceny after breaking or entering. Lowery was sentenced to 50-60 months in prison.

Derek Manning, 38, plead guilty to selling cocaine within 1000 feet of a school; he was sentenced to 40-57 months in prison.

Willie Marble, 38, pled guilty to 1) felony breaking or entering, 2) possession with intent to sell or deliver marijuana, and 3) possession with intent to sell or deliver cocaine. Marble was sentenced to 24-30 months in prison. However, after a request from the defendant, Judge Williamson ordered that his sentence shall not begin until January 9, 2012; Marble was ordered to report to the Mecklenburg County Jail on that date.

Levitcus Johnson, 28, plead guilty to 1) felony breaking or entering and 2) felony larceny after breaking or entering. Johnson was sentenced to 38-55 months in prison.

Cornelius Tillman, 33, plead guilty to selling ccocaine within 1000 feet of a school; he was sentenced to 63-85 months in prison. However, after a request from the defendant, Judge Williamson ordered that his sentence shall not begin until January 6, 2012; Tillman was ordered to report to the Mecklenburg County Jail on that date.

Frenchetta Parker, 34, plead guilty to 1) five counts of identity theft and 2) larceny by employee. Parker also admitted probation violations; she was sentenced to 48-60 months in prison.

Barby Barchue, 34, plead guilty to trafficking in cocaine; he was sentenced to 35-42 months in prison and fined $50,000.

Demario Jenkins, 32, plead guilty to 1) two counts of felony possession of stolen goods and 2) being a habitual felon. Jenkins was sentenced to 58-79 months in prison.

On December 27, 2007, Kellie Owens was found dead in her University City apartment. Her 2-year old daughter was found unharmed inside the apartment. To this day, Kellie Owens murder remains unsolved.

Last week, Owens' mother, Linda, spoke with the media to ask for the public's help in locating her daughter's killer. She said she's experienced "unimaginable pain" since the death of her only child.

CMPD Investigating Robbery/Shooting on Archdale Dr

Detectives with the Charlotte-Mecklenburg Police Department Robbery Unit are conducting an investigation into an Armed Robbery that resulted in a shooting which took place on Archdale Dr, located in the Westover Division. The incident left one person injured.

Westover Division Officers responded to the 5900 block of South Boulevard to investigate the report of a person shot. When officers arrived on scene, they located a black male subject suffering from an apparent gunshot wound. Medic transported the victim to Carolinas Medical Center, where he was rushed into surgery upon arrival. The victim was able to advise who shot him and the location as well.

Based on the initial investigation, the subject was meeting the suspect to conduct a transaction and as he was walking away, the suspect shot him and fled the scene on foot. As officers were canvassing the area for the suspect, officers located the suspect and a foot chase ensued. While doing so, an officer was injured while attempting to scale a wrought iron fence. He was transported to Presbyterian Hospital for treatment of his injuries. The suspect was apprehended and taken to the Law Enforcement Center for questioning. Detectives are canvassing the neighborhood to determine if there are any additional witnesses to this incident.

Crime Scene Search responded to the call for service to process and collect physical evidence. The K-9 Unit, Vice & Narcotics, and the Gang Unit responded to the scene as well to aid in the investigation.

Pedestrian Killed by Drunk Driver

Victim: Autumn Soyka

On October 30th around 1:00am, Autumn Lynn Soyka, was attempting to cross the 1900 block of E. 7th Street when she was struck by the left front bumper of a 2004 Cadillac CTS being driven by Stephen Watts.

The collision occurred in the inbound right lane of E. 7th Street. Autumn Soyka was not crossing at an intersection and was not in a marked crosswalk at the time of the collision. The victim was pronounced deceased at the scene of the collision due to injuries sustained during the crash.

Mr. Watts stopped and remained at the scene of the collision until police arrived. Field sobriety tests indicated Mr. Watts was impaired and he was placed under arrest and charged with DWI, Involuntary Manslaughter and License Restriction Violation.

CMPD Investigating Domestic Stabbing Death in Hidden Valley

Charlotte-Mecklenburg Police Department A/D/W and Homicide Units are conducting an investigation into a domestic violence call, which left Francis Xavier Stewart deceased. The incident took place at 4718 Cinderella Road in the North Tryon Division. The call for service came in at 12:15 am, on Sunday October 30, 2011.

North Tryon Division officers received a call for service in reference to a male subject that had been stabbed by his wife. When officers arrived, they located the victim suffering from a stab wound. Medic arrived and pronounced the victim deceased on scene. The victim and suspect were known to each other, this is not a random act of violence. Detectives are not looking for any additional suspects.

Clinicians with the Child Development-Community Policing (CDCP) Program were dispatched and responded to the Law Enforcement Center because children were present during the incident. The CDCP is a partnership between the CMPD and Mecklenburg County Provided Services Organization.

Crime Scene Search responded to the call for service to process the scene and collect physical evidence. Special Victims Unit Detectives and the Mecklenburg County District Attorney’s Homicide Prosecution Team responded to the scene as well.

Rapist Sentenced to 84 years in Prison

Jarrod Willis

On October 26, 2011, Jarrod Willis, 30, was convicted of first-degree rape, first-degree sex offense, first-degree kidnapping and robbery with a dangerous weapon. The jury found the defendant guilty after a three-day trial in front of the Honorable Timothy S. Kincaid, Superior Court Judge, in the Mecklenburg County Courthouse.

On March 12, 2009, Willis drove up beside the victim and forced her into his car at gunpoint. He drove to a secluded location and sexually assaulted and robbed her. Forensic nurses collected DNA evidence from the victim.

Willis was developed as a suspect after his DNA was collected from an unrelated felony conviction. His DNA was put into the national database (CODIS) and he was identified as her attacker.

Judge Kincaid sentenced the defendant to a total of 1,018 - 1,259 months in prison (approximately 84-105 years)

Johnson & Wales Student Robbed Uptown

According to WSOC-TV & WCNC, another Johnson & Smith student was robbed in uptown Charlotte this morning. CMPD did not send a news release and the two news stations are reporting different locations of where the robbery occurred as either on W Trade Street or W Fifth Street.

The student said he was knocked to the ground by three men who took his wallet and left in a small white sedan with black trim.

Since April, 7 people have been robbed or attacked in the Gateway area (4th Ward) of uptown, including one in September and two in October. Police told the news stations they will increase patrol in the area.

Child Molester Convicted & Sent to Prison for 32 years

Michael McDaris

On October 26, 2011, Michael McDaris, age 63, was convicted of two counts of statutory rape. The jury rendered its guilty verdict after a three day trial held in front of the Honorable Robert C. Ervin, Superior Court Judge in the Mecklenburg County Courthouse.

McDaris repeatedly molested and raped a teenage family member over a period of years between 2003 and 2004. The victim was 14 and 15 years old at the time that she was raped by the defendant. The victim in that case was afraid to come forward until five years later, when she decided to report the crimes to the Mint Hill Police Department.

The victim, now 23, testified in front of the jury this week about the years of abuse she suffered at the hands of the defendant. The defendant gave a statement to the Mint Hill Police admitting the molestation and rape of this girl. After all of the evidence was presented, the jury deliberated for approximately an hour and ten minutes before rendering their verdict of guilty, as charged, to both counts of statutory rape.

At sentencing, the victim and her mother read victim impact statements to the Court. The victim told the judge that testifying against the man who raped her was the hardest thing she had ever done, but that after the verdict she “felt free and was now a survivor.” She also asked the judge to sentence the defendant to two consecutive prison sentences for the rapes. Judge Ervin sentenced the defendant to a minimum of 192-240 months in prison for each charge; he will serve a total sentence of 32-40 years in prison.

DNA Assists Homicide Detectives Solve 2007 Robbery & Murder Case

On May 2, 2007, Anita Rychlik, a 45-year old motel manager was shot in the head and killed during an armed robbery. She was working for the Thrift Motel, which is located at 3700 North Tryon St.

In 2007, witnesses stated that three suspects approached the security guard who was later identified as Mrs. Rychlik’s husband. The suspects pistol whipped the security guard and entered the room he shared with his wife. A struggle then gunshot were heard a short time later before the suspects ran from the location.

CMPD has announced they have solved the homicide and have arrested Bobby Johnson, Antonio Lee Chaney and Joshua Raphael Chaney. All three suspects have been charged with the robbery and murder of Anita Jean Rychlik.

New information and DNA evidence linked the three suspects to the murder. All three suspects have been apprehended without incident and have been charged with Murder, Armed Robbery and Conspiracy to Commit Armed Robbery. CMPD Arrests Suspects who Robbed Kings Cleaners and Launderette

UPDATE: The first suspect in this case has been identified as Dapatrick Richardson. Richardson has been charged with Robbery With a Dangerous Weapon, Conspiracy, Possession of Firearm by Convicted Felon, Possession of Stolen Firearm, Possession of Stolen Vehicle, Assault with a Deadly Weapon on a Law Enforcement Officer and Resisting Arrest. * Richardson was previously convicted of robbery with a dangerous weapon in Cabarrus County on 03/16/2005.

The second suspect has been identified as Dequrius Greene. He has been charged with Robbery With a Dangerous Weapon, Conspiracy, Felony Flee to Elude, Possession of Stolen Vehicle and Reckless Driving.

Detectives from the Firearms Division are evaluating this case for possible prosecution at the federal level.

Detectives with the Charlotte-Mecklenburg Police Department are investigating an armed robbery that occurred this afternoon around 3:30 pm. North Tryon Division officers responded to 632 West Sugar Creek Road concerning an armed robbery of Kings Cleaner and Launderette. It was reported that two robbery suspects got into vehicle and fled the location in the direction of the Hidden Valley neighborhood.

Dequrius Greene

A short time later, a North Tryon Division officer located the suspects’ vehicle on Spring Garden Lane. The officer activated his emergency lights and siren and attempted to conduct a vehicle stop. The suspect operating the vehicle refused to stop and subsequently lost control of the vehicle and struck a parked unoccupied car at a home located at 1500 Pondella Drive.

The suspect who was operating the vehicle was immediately taken into custody. The passenger suspect jumped and ran into a wooded area at Spring Garden Lane and Pondella Drive. Officers pursued the suspect on foot through the heavily wooded area and indicated the suspect fired several shots. The passenger suspect was apprehended a short time later in the wooded area. The gun he was carrying was recovered at the scene of his arrest.

Robbery Unit Detectives are on the scene investigating the incident. Homicide Detectives are also present investigating whether the fleeing suspect attempted to fire shots at officers.

CMPD's Information Shutdown to Citizens & Media Outlets

I started this crime blog in February of 2006 and soon thereafter CMPD granted me 'media' access to all of the same information provided by the CMPD to the media outlets.

At that time, Darrell Stephens was CMPD’s Chief of Police and he was dedicated to working with the media and citizens to provide accurate and updated crime information on a daily basis.

In January of 2007, CMPD re-designed its website and established public access to a '911 calls for service' feature. This allowed citizens to see all 911 calls for service within an 8-hour time frame. The log could be searched by police division and/or time period. (Email Announcement)

In September of 2007, CMPD added the 'Significant Event Log' feature to its website. (I tracked almost daily here) Prior to the Significant Event Log, CMPD would email the media a 'Watch Commanders Report' on a daily basis. The SE Log allowed Charlotte citizens to see all major crimes (robberies, sexual assaults, etc) that occurred in Charlotte within a 24-hour time period. (Email Announcement)

After Rodney Monroe was elected Chief of Charlotte-Mecklenburg Police, both of the online crime resources mentioned above were quickly removed from the CMPD website without any explanation. CMPD kept the archaic 'Crime Mapping' feature but it is difficult to use, is only updated once per week and does not provide citizens with any detailed information, I consider it pointless!

In addition, CMPD Public Information Officers have nearly stopped sending media briefs unless it is a homicide, serious accident, electronic monitoring cut & run and sometimes we get lucky and receive surveillance photos of a wanted subject. Needless to say, since Chief Monroe's tenure, CMPD has nearly stopped communicating crime information to the public and media. WHY?

In the past two years, the Charlotte-Mecklenburg Police Department has taken a disconcerting direction in the way it handles real-time crime information. The changes in practice have been hush-hush and done without any justification. The CMPD has changed from being one of the most open police departments in NC to one of the most restrictive, as it relates to public crime information access.

In my opinion, the public has the right to access real-time crime information as we did before and we shouldn't be denied it any longer! Police Chief Rodney Monroe was hired to deal with crime in Charlotte but in reality his duties have included restricting the public's 'right to know' what crime is happening around us.

The only way this nonsense will STOP is if enough citizens speak up! Check out this post by the Cedar Posts blog and write our Mayor and City Council members today demanding CMPD restore public access to crime information in Charlotte. I also suggest Chief Monroe and the Public Information Officers read this article as "community policing" includes keeping citizens informed!

Man Arrested for Possession of Child Porn

SBI Agents say they traced sexually explicit video and pictures of small children back to the IP address on his computer.

CMPD Officer Hit by Vehicle; Suspect Captured in Georgia

Case Update: Officer Kunz was released from CMC earlier this morning. He does not have any broken bones in his arms or legs, but may have broken ribs. He will see a doctor today to follow up on treatment for soreness and bruising to his chest area.

Homicide Unit Detectives signed warrants on the suspect, Ivory Chappell for Assault with a Deadly Weapon on a Law Enforcement Officer and Felony Hit and Run. VCAT began tracking Mr. Chappell as soon as they were assigned the case and quickly determined that he was in Georgia, east of Atlanta. VCAT contacted the FBI Task Force in Atlanta request their assistance. Mr. Chappell was arrested on Tadmore Lane in Lithonia GA, by the DeKalb County Police Department.

The Georgia State Patrol assisted with the investigation as well. Mr. Chappell will be housed at the Dekalb County Sheriff’s Office until he clears extradition. The Dodge Charger was recovered and will be towed to Charlotte for processing. Mr. Chappell had an outstanding OFA (Order for Arrest) out of North Carolina at the time he fled the scene.

Officer Charles Adkins is the officer who fired the shots at Mr. Chappell as he fled the scene last night. He has been employed with the CMPD since January 22, 2007, and is currently assigned to the Westover Division as a patrol officer. He has been placed on Administrative Leave pending the outcome of the Internal Affairs investigation into the incident.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and A/D/W Unit are conducting an investigation into an ADW on an CMPD Officer which occurred in the parking lot of 6035 Nations Ford Road in the Westover Division. Officers were initially on scene to investigate a report of a larceny from auto complaint which was reported at 8:04 pm on Thursday, October 20, 2011.

Westover Division Officers responded to Extended Stay America in order to investigate the report of a larceny from auto call placed by a guest of the hotel. After officers arrived on the scene and began to walk to the rear entrance, they encountered a couple with a small child having some type of dispute. During the dispute between the couple, the child was dropped to the ground. The female who was on scene is at Carolinas Medical Center along with the baby for observation.

Based on initial statements from officers, once the male subject saw the Officers approach, he immediately ran for a white Dodge Charger and fled the scene, striking Officer Chris Kunz in the process. Officer Kunz’ partner fired multiple shots at the suspect vehicle as it fled the scene, At this time, it is unknown whether or not the Charger or the suspect was struck by gunfire. The Charger is believed to have fled onto I-77 and has yet to be located.

Officer Kunz has been with the CMPD since September 8, 2008, and is currently assigned to Westover Division as a patrol officer. He is currently at Carolinas Medical Center with non-life threatening injuries. Once the family of Officer Kunz’ partner has been notified, his name will be released.

Detectives are currently canvassing the hotel to determine if there are any additional witnesses to the incident. Crime Scene Search responded to the call for service to process the scene and collect physical evidence. Detectives with the Major Crash Investigation Unit responded to the scene to assist with the investigation. The Aviation Unit’s Helicopter responded to the scene in an attempt to locate the suspect vehicle. Internal Affairs responded as well to conduct a separate but parallel investigation into the incident to determine whether or not CMPD Policies and Procedures were adhered to. Detectives with Violent Criminal Apprehension Team and the Gang Unit are assisting in locating the suspect.

Tracy Harold is wanted again by the Violent Criminal Apprehension Team (VCAT) for outstanding warrants for interfering with an electronic monitoring device, damage to property, and armed robbery.

Harold has been on CMPD electronic monitoring since his October 15, 2011 release from jail on a $43,000 bond for a pending armed robbery charge.

On October 21, 2011 Harold cut off his court ordered monitor and is currently on the run. Harold was last seen in the area of Charlottetown Ave and 7th Street.

Tracy Harold has previously been arrested for felony drug and weapon charges in Mecklenburg County. Anyone with information on Harold’s whereabouts should immediately contact the Violent Criminal Apprehension Team (VCAT) at (704)336-VACT or call 911.

According to CMPD, Harold is the 21st offender to cut off a CMPD electronic monitor in 2011. In 2011, less than 2% of the offenders monitored cut off their monitors and all of the previous 20 offenders have been recaptured.

Fifty-two (52) defendants plead guilty in Mecklenburg County Superior Court before The Honorable Robert C. Ervin, Superior Court Judge. The defendants entered their guilty pleas from October 3, 2011 - October 7, 2011. Among them were:

Kenneth Davis, 24, plead guilty to 1) robbery with a dangerous weapon and 2) discharging a firearm into occupied property. Davis was sentenced to 73-97 months in prison.

Daniel Robinson, 25, pled guilty to robbery with a dangerous weapon. Robinson was sentenced to 44-62 months in prison.

Christopher Moses, 23, pled guilty to robbery with a dangerous weapon. Moses was sentenced to 51-71 months in prison.

Jamarcus Reams, 25, pled guilty to discharging a firearm into an occupied vehicle. Reams was sentenced to 23-37 months in prison.

Antoine Ballard, 26, pled guilty to second degree rape of a child. Ballard was sentenced to 104-134 months in prison.

Enrique Aspauzo, 19, pled guilty to attempted statutory rape. Aspauzo was sentenced to 60-81 months in prison.

Thomas Cherry, 36, pled guilty to three counts of indecent liberties with a child. Cherry was sentenced to 60-72 months in prison.

Paul Abuzayed, 31, pled guilty to assault with a deadly weapon inflicting serious injury. Abuzayed was sentenced to 20-33 months in prison.

Jairo Alfaro Umanzor, 29, pled guilty to two counts of robbery with a dangerous weapon. Umanzor was sentenced to 48-67 months in prison.

CMPD Cracking Down on Prostitution in NODA

The Charlotte-Mecklenburg Police Department announced yesterday they are cracking down on drugs, prostitution and johns in the NODA area of Charlotte, specifically near the intersection of 36th St & The Plaza.

Police say their attempt to curb criminal activity in this area using multiple resources (including helpful citizens & undercover stings) has helped drop the crime rate in the CMPD Eastway Division and across the city.

CMPD said within a 2 month time period, they have made 20+ arrests and obtained search warrants for 3 suspected crime ridden homes. During the raids, they found cash, drugs and guns at all three houses. If you look at my mugshot slideshow, you will notice a much higher rate of prostitution arrests in the past few months.

Dumb Criminals: Men Report Stolen Drugs to Police

WBTV News reported that two men flagged down a police officer on Marmion Rd to report that two men robbed them of their cocaine and marijuana stash and $1,100.

WBTV stated the police report said the so called "victims"- a 65-year old man and 36-year-old man told police two unknown suspects were invited into the home after they knocked at the door.

After the suspects were inside, they robbed the victims at gunpoint. The report also mentioned the two victims were under the influence of alcohol and drugs at the time of the robbery and sustained minor injuries.

Police said that the two victims were not charged even though they told officers they had drugs stolen.

Through the end of September, the preliminary total for Index Offenses was -7.8% lower than this time last year. Property crime decreased by -8.2% while violent crime decreased by -4.8%.

40 homicides were reported through September compared to 48, resulting in a decrease of -16.7%.
1,134 robberies were reported compared to 1,350, resulting in a decrease of -16.0%
167 rapes were reported compared to 167, staying flat at 0.0%
2193 aggravated assaults were reported compared to 2,147, resulting in an increase of 2.1%
Burglary overall was down -6.3%, (6,226 compared to 6,642) with a decrease of -12.1% in residential (4,559 compared to 5,186) and an increase of 14.5% in commercial cases (1,667 compared to 1,456). This increase in commercial burglaries is due to several cases where multiple units were burglarized at mini-storage facilities.
1,548 vehicle thefts were reported compared to 2,071, resulting in a decrease of -25.3%.
Total larceny cases declined by -6.7% (15,744 compared to 16,874) with the larcenies from auto down by -19.6% (6,086 compared to 7,569).
147 arson cases were reported compared to 199, resulting in a decrease of -26.1%.

Three Homes & One Teen Hit by Drive-By Shooters

Shortly before 2:30 am, a drive-by shooting occurred on Greylock Court, which is near Old Concord Road and Rocky River Road. The 17-year old victim, who was in his garage, was struck by a bullet in the thigh and is expected to fully recover.

During the shooting (possibly coming from two different vehicles) at least three houses were struck with bullets. The CMPD has not released any additional information about the suspects nor made any arrests.

Man Kills Both Parents in Huntersville, NC

David Hamilton

UPDATE: David William Hamilton, 26, was returned to Mecklenburg County today after his apprehension in Myrtle Beach, SC on September 30th. He is accused of killing his parents, James Hamilton, 73 and Stephanie Hamilton, 56. The Huntersville Police Department found the couple dead on Sept 30, 2011 in their home off Huntersville-Concord Road.

In addition to the two murder charges, David Hamilton is being held for violating his probation stemming from an arrest in 2007 for Burglary, B&E and Larceny in Mooresville, which is located in Iredell County.

Hamilton is said to have violated his probation while in Washington, DC when he jumped the fence at German Embassy in April 2011.

Police Seeking ID of Several Pharmacy Robbers

UPDATE: On October 14, 2011 through collaborative efforts with Rock Hill PD, York County Sheriff, Lancaster PD and Lancaster Sheriff, Ronald Carl Sims was identified and warrants for his arrest were obtained. Mr. Sims was arrested in Rock Hill, SC. All agencies, including CMPD are continuously working together to identify other subjects affiliated with these cases.

Charlotte-Mecklenburg Crime Stoppers is now offering a cash reward of up to $6,000 for information leading to the apprehension of several subjects believed to be responsible for a series of recent pharmacy robberies.

The robberies have occurred at the Rite-Aid pharmacy located at 2215 West Arrowood Road on October 7th, the Rite Aid at 15521 John J. Delaney Dr. on October 2nd and the Harris Teeter pharmacy located at 16625 Lancaster Highway on September 25th. The subjects have also been involved in multiple pharmacy robberies in York County, South Carolina.

The additional reward money has been donated by the pharmaceutical company Purdue Pharma L.P., in cooperation with RxPATROL®, a collaborative effort between industry officials, pharmacists and law enforcement to collect, analyze and disseminate information on pharmacy theft.

Teen Found Dead on Arbroath Court

UPDATE II: Homicide Unit Detectives have arrested Nicholas Eshaad Wright and charged him with the murder of Aerial Patterson. He has also been charged with Armed Robbery and is currently in the custody of the Mecklenburg County Sheriff’s Office.

UPDATE I: With the assistance of CMPD's Violent Criminal Apprehension Team (VCAT), Steele Creek Division officers, and members of Vice and Narcotics; Eddie Yannick Doh, was apprehended and charged with the murder of Ms. Patterson.

Additionally, Eddie Doh was charged with Armed Robbery and Possession of Firearm by Felon and has been transported to the Mecklenburg County Sheriff's Office where he will remain in their custody.

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit are conducting a homicide investigation at 15129 Arbroath Court, which is located in the Steele Creek Division. The call for service came in at 3:42 am. The female victim has been positively identified as 17-year old Aerial Patterson.

According to the CMPD, Steele Creek Division officers responded to Arbroath and found Miss Patterson suffering from fatal injuries. She was pronounced deceased on scene.

Eddie Doh

According to a friend of the victim, she was dropped off at the above address by a friend to meet an unknown person through a pre-arrangement. When her friend came back to pick up the victim, she was discovered deceased in the yard. The address where the victim was located is an unoccupied residence.

The friend of the victim is cooperating with the investigation and has voluntarily been taken to Police Headquarters to provide a statement. Detectives are canvassing the neighborhood in an effort to identify any witnesses.

Crime Scene Search responded to the call for service to process the scene and collect physical and forensic evidence. In addition, the Mecklenburg County District Attorney’s Homicide Prosecution Team responded to the scene.

Motel on Reagan Drive in Jeopardy of Closing due to Criminal Activity

The CMPD has its eye on yet another 'no-tell motel' which is known for having drugs, prostitution, assaults, threats and gunfire occurring on the premises. The motel is America's Best Value Inn, located on Reagan Drive.

CMPD had told the motel owners they need to take care of the problems or it will be shut down but the motel owners did not adhere to CMPD's requests. A preliminary injunction was filed so now a Judge will decide if the motel should close.

According to the preliminary injunction, the motel is not allowed to continue renting rooms by the hour or to anyone who lives in the 282 zip code. All guests must have a valid ID and motel workers must screen its patrons for any drug or prostitution arrests prior to renting a room.

CMPD Arrests Maryland Fugitive & Murder Suspect

UPDATE: 10/18/11- Sadly, William McQuian was found deceased in Maryland today.

On Thursday morning, CMPD arrested fugitive/murder suspect Curtis Maruice Lopez at the Econo Lodge off Independence Blvd.

Lopez was wanted in Montgomery County, Maryland for murdering his estranged wife, Jane McQuain, in Germantown, MD. McQuain's 11-year old son William McQuain is still missing!

Homicide Detectives in Maryland were hoping to find the boy with Curtis Lopez but he was found to be alone when he was arrested here in Charlotte.

The missing boy, William McQuain was last seen on September 30th at his middle school in Maryland.

Detectives Investigating Homicide on Rogers Street

Detectives with the Charlotte-Mecklenburg Police Department Homicide Unit and A/D/W Unit are conducting an investigation into a shooting which occurred in the front yard of 3727 Rogers Street. The call for service was reported at 10:56 pm on Thursday, October 13, 2011. The victim has been positively identified as James Love. CMPD has charged Derrick Huey with murder.

Metro Division Officers responded to an ADW-with Injury call. When officers arrived on the scene, they found a male subject lying on the ground suffering from an apparent gunshot wound. Medic arrived and transported the victim to Carolinas Medical Center where he was pronounced deceased upon arrival.

Based upon initial witness statements, Mr. James Love and Derrick Huey were involved in an altercation which led to the shooting. The two men were known to each other- this is not a random act of violence. Huey was located a short distance away and has been transported to police headquarters for questioning and booked in the Mecklenburg County Jail.

Detectives are currently canvassing the surrounding neighborhood to determine if there are any additional witnesses to the incident. Detectives are not looking for any additional suspects at this time.

Clinicians with the Child Development-Community Policing (CDCP) Program, as there were several children inside the home at the time of the incident. The CDCP is a partnership between the CMPD and Mecklenburg County Provided Services Organization. For additional information on the CDCP, click here.

Demone Lamont Evans, 26, plead guilty to two counts of second-degree murder for the 2010 murders of Tia Mitchell, 23, and Dominique McGriff, 21.

The Honorable Richard D. Boner, Senior Resident Superior Court Judge, sentenced Evans to 268-340 months (22-28 years) in prison.

DA: Heroin Trafficker Convicted; Other Drug Offenders Plead Guilty

The District Attorney’s Drug Prosecution Team prosecuted six defendants the week of October 3-7, 2011, in Mecklenburg County Superior Court. Two cases were called for trial and four defendants entered guilty pleas before the Honorable Yvonne Mims Evans and the Honorable Hugh B. Lewis, Superior Court Judges.

Rudolph Brooks

Juan Partida Rodriguez, 27, was tried for 1) two counts of conspiracy to traffic in heroin, 2) two counts of trafficking in heroin and 3) possession with intent to sell or deliver heroin. The jury returned a verdict of guilty on all charges. Judge Lewis sentenced Rodriguez to 140-168 months in prison.

Rudolph Brooks, 38, was tried for 1) eight counts of trafficking in heroin, 2) one count of sale of heroin, and 3) three counts of possession with intent to sell or deliver heroin. Judge Evans declared a mistrial, as the jury deadlocked and was unable to reach a unanimous verdict.

Four defendants plead guilty before their cases were called for trial:

William Richardson, 56, plead guilty to possession with intent to sell or deliver heroin. Judge Lewis sentenced Richardson to 16-20 months in prison.

Joel McCutchen

Joel McCutchen, 33, plead guilty to two counts of obtaining a controlled substance by misrepresenting oneself as a licensed practitioner. Judge Evans sentenced McCutchen to 45 days in the county jail; that sentence was suspended pending his successful completion of 12 months of supervised probation.

Jean Brown, 52, plead guilty to obtaining a controlled substance by fraud. Judge Evans deferred sentencing of Brown, pending her successful completion of 12 months of supervised probation.

Shawn Lee, 25, plead guilty to possession of cocaine. Judge Lewis sentenced Lee to 8-10 months in prison.

Diamond Cab Driver Stabbed near Old Eastland Mall

A Diamond Cab Company driver was viciously stabbed during a robbery around 11pm near the old Eastland Mall. The driver, Kofi Awutey, is in serious condition at CMC.

Kofi Awutey was rushed to the hospital with what police call life threatening injuries. The owner of the cab company said the passenger was picked up on Albemarle Rd and called from a pay phone.
